DETROIT (AP) — A judge on Wednesday struck down Michigan's 1931 anti-abortion law, months after suspending it, the latest development over abortion rights in a state where the issue is being argued in courtrooms and, possibly, at the ballot box.
The law, which was long dormant before the U.S. Supreme Court overturned Roe v. Wade in June, violates the Michigan Constitution, said Judge Elizabeth Gleicher.
“A law denying safe, routine medical care not only denies women of their ability to control their bodies and their lives — it denies them of their dignity,” Gleicher of the Court of Claims wrote. “Michigan’s Constitution forbids this violation of due process.”
The decision comes as the Michigan Supreme Court is considering whether to place a proposed amendment on the Nov. 8 ballot that would add abortion rights to the state constitution. A Friday deadline is looming.
Supporters submitted more than 700,000 signatures, easily clearing the threshold. But a tie vote by the Board of State Canvassers over spacing issues on the petition has kept it off the ballot so far.
In the case handled by Gleicher, the 1931 law makes it a crime to perform an abortion unless the mother's life is in danger.
The judge said the law “compels motherhood” and prevents a woman from determining the “shape of her present and future life.”
The law “forces a pregnant woman to forgo her reproductive choices and to instead serve as `an involuntary vessel entitled to no more respect than other forms of collectively owned property,'” Gleicher wrote, quoting constitutional scholar Laurence Tribe.

Some Judges need to be impeached and removed, but our legislators are, in general, mentally weak.
If the ballot proposal makes it onto the ballot, it will easily pass. It needs to be stopped at the state supreme court.

Whatever happened to the claim that abortion would only be “safe, legal and rare”? It was made safe, and legal, in many jurisdictions, but rare?
The rabid supporters of this procedure made it anything but “rare”, and “legal” was a very tortured extension of reasoning, especially when it went beyond the probability of viability of the fetus.
And “safe”. A successful abortion is 100% lethal to the fetus, and there is a certain probability the “birthing person” (to use the politically correct term) may suffer consequences, including permanent sterility, emotional trauma, or even death.
Some instances of abortion may be necessary, but that is still a decision with grave responsibilities attached, and the risk/benefit ratio is overwhelming.
Apparently, this judge has appointed herself as the Michigan legislature. She does not understand her job, or the law, for that matter.

Utterly amazing they whipped up 700k+ “valid” signatures on their petition to “easily clear the hurdle”, when Michiganders couldn’t gather 300k+ legal signatures on yet *another* attempt to recall Gretchen.
Almost makes you wonder if some of the democrat voters were resurrected more often than every four years...
Certainly not a “safe” medical procedure for the baby.

Wasn’t the Supreme Court’s intent to let the state legislators figure out a solution, so the courts don’t end up making laws?
Same problem different face.
Democrats don’t believe in democracy. This is a decision for the people, as outlined by the SCOTUS. That means the closest people get to democracy. That closeness is at a state legislature level.
This is a single individual abusing their power and injecting an opinion against the people. It’s disgusting and judges like this should be removed. That should be, regardless if Michigan changes or adopts new abortion laws.

Clear and total judicial activism… nothing cited in her ruling has any basis in law.
Judge Elizabeth Gleicher needs to be impeached and removed from office then tried, convicted and sentenced for malfeasance, misfeasance, and nonfeasance.
Post natal abortion for judge should follow her ruling. She has made many feel unappreciated by her ruling so by her own rules she qualifies.
