Law Signed by Andrew Cuomo Bans Public Release of Mugshot for Lee Zeldin Attack Suspect

A New York state law, signed by former Gov. Andrew Cuomo, is preventing the public release of the booking photo for a man accused of attempting to stab Rep. Lee Zeldin.

In 2019, Cuomo sought to ban the public release of all booking photos, arrest records, names, and charges for suspects accused of crimes. The state’s Democrat-controlled legislature moved forward with a similar plan that prevents local and state police from releasing a suspect’s booking photo to the public unless it serves a law enforcement purpose.

The law, which Gov. Kathy Hochul (D) has never objected to, is now helping to protect the suspect accused of attempting to stab Zeldin, who is running as the Republican challenger against Hochul in the state’s gubernatorial race.

In an inquiry to the Monroe County Sheriff’s Office, Breitbart News asked for the booking photo of 43-year-old David G. Jakubonis — the man accused of attempting to stab Zeldin. Officials responded, “pursuant to [New York] Public Officer law section 89-2(b)(viii), we are unable to release Mr. Jakubonis’ booking photo.”

Thanks to another Cuomo-approved law, Jakubonis was released from Monroe County Sheriff’s Office custody immediately following his arrest as a result of the state’s “No Bail” law, which allows suspects accused of violent crimes to be released from jail without having to pay bail.

On Saturday, Jakubonis was charged with federal assault charges, which could lead to the release of his booking photo and possibly keep him behind bars until he faces trial.

Jakubonis is due back in New York court on August 30.

Someone arrested for a crime should not have their info released. Someone convicted of a crime should always have their info released. The concept of innocent until proven guilty should be afforded to those who stand accused. The concept of punishment of the guilty should include public disclosure of the crimes committed as well as the name and place of residence of the guilty.

Sorry Nico, but you are wrong! If a photo exists of a party being sought be the police, then it should be released to the press.

If a picture was taken by a private party of the get- away, should it not be published by the press since the alleged criminal has not been convicted? Yes?? Nonsense.

Suppose left-wing death squads start picking up its enemies (us) and throwing us in the back of their jails, throwing away the key, and “forgetting” we are there? At least a public booking photo would be some evidence the “perp” was arrested and in custody. Of course i don’t put it past the current crop of leftist scum to do away with all arrest records altogether, but at least a requirement to make booking photos public would put a foot in the door.

illegal arrests are illegal. I see where you are going with this, and I can see your logic clearly, but those sorts of arrests should never happen since they are not legal. Kinds of a catch 22 situation. Have your name shown for being arrested and potentially lose your job or whatever over it without even being convicted, or get black-bagged and never seen again. damned if you do and damned if you don’t.

Written like a true liberal. The release of such photos has lead to many convictions of serial rapists. Oregon adopted this law, and now released criminals are free to go on their crime sprees, with the public having no ability to connect the dots.

You clearly lack the ability to think through the chain of events that occur when someone has their information posted for getting arrested for being ALLEGED to have perpetrated a crime.

People who are not convicted of a crime should not have their lives ruined in the internet age by having their information released. And so its clear, what I mean by INTERNET AGE is that once such information is released, it goes on the internet FOREVER. 5 years down the road, having been fully acquitted of a crime that they were accused of, and applying for a new job, the potential new employer does an internet search which returns name and photo of the accused and the crime they were alleged to have committed. The person can’t get a job because of an accusation that was found to be unjustified.

I swear, the ability to reason and see the consequences of actions has been utterly lost in the modern age. I feel like I am the only person who can think through and reason out the chain of events because MORONS resort to calling me a liberal when they can’t do this simple feat of logic.

I am not even sure who said this, but I read once that its better for 6 guilty men to go free than 1 innocent man be convicted. If you think how justice and injustice weigh on your conscience, and how righteous anger follows unjust conviction, and then what the results of righteous anger can be (unlawful vigilantism, unlawful revenge) you can see how its better to let the guilty go free than to have a non-guilty righteous person stand up for themselves and destroy the system. Even if they don’t use unjust means to do so, they can sue and get reparations of millions of tax-payer dollars for their unjust conviction and unjust punishment. Does that really seem like an equitable solution for the tax payers, the court system, the police department, and the unjustly convicted?

Try thinking things through. It appears to be challenging for your tiny tiny brain, but its a necessary skill and even though it takes you longer to do so than most, the correct result can still be achieved even if its days later.

Agreed but the Dems will find that that this law bites them. They love to release booking files and photos of their enemies; now they can’t! I see the main stream media mounting a huge legal challenge to it!

The fact that you had to throw unjust convictions into your argument shows the weakness of your argument. Arrests should be publicized, just like ALL government actions.

Wow, libtard gaslighting. My argument is quite the opposite of weak, commie.

There used to be a practice of publishing arrests in the newspaper that were more or less anonymous- usually what I have seen with this is that “A man in his 30s from 23rd street was arrested for drunk and disorderly” That’s enough to tell someone related to him where he disappeared to. This is sufficient for purposes of alerting the public and the relations of the person as to the alleged perpetrator’s whereabouts. Generally, if someone disappears you call the police anyways.

As an example of why public disclosure of arrests is needed, I supervised about 6 subordinates in my last job. One day I saw other employees in the lunch room laughing over one of those bondsmen magazines that post pictures of the latest arrestees with brief descriptions of their ALLEGED crimes. They pointed out one of my employees responsible for the entire organization’s payroll had been arrested for insurance fraud. The employee never told me about her arrest. I looked into the matter and found out she had indeed perpetrated insurance fraud in some convoluted scheme to protect her son from the consequences of driving a car involved in an accident. She said she was driving, when there was evidence she was no where near the car when it wrecked. I examined her work closely looking for any hint of impropriety in the payroll and luckily found none, but without that trashy publication I would not have known about her arrest. It’s one thing to punish someone for something they were only ALLEGED to have done, but it another thing to ignore the signs of potential lawbreaking.
