The first clip, released by the NYPD on July 5, showed ex-con Austin Simon, 35, shoving store clerk Jose Alba, 61, against the wall after the younger man walked behind the register of the Blue Moon convenience store in Hamilton Heights on July 1.
Police say Simon attacked Alba after the 35-year-old man’s girlfriend got into an argument with the clerk because she couldn’t pay for a bag of chips.
The footage showed Alba attempting to walk away from Simon after being shoved, then plunging a knife into his neck and torso repeatedly as the two wrestled with each other.

Seems to me that Austin Simon, uh, “F***ed around and found out”, as they like to say in his neighborhood.

How much longer is this charade going to be allowed to go on? This is a grotesque miscarriage of justice.
Might need to watch the vid again but IIRC as Alba was attempting to walk away Simon had him by the arm - so Alba still being attacked as he walked away.
Alba was verbally and physically attacked, walked away while still being attacked, and defended himself.
Bail was significantly reduced which seems to show the Court’s position. However this is NYC.
Watched the vid again and yes Simon had Alba by the arm and shoulder in a take-down type of hold.
Alba still being attacked when he defended himself.
