As a matter of principle, when President Trump is reelected, he should ask some of the feistier Republican congressional chairmen to at their convenience, subpoena a BUNCH of records about Democrats that would fall under this decision, that would otherwise be unthinkable to subpoena.
This would both be payback to the Dems, and a wrist slap to the SCOTUS, if they refuse. And if the SCOTUS refuses, the senate and house judiciary committees should both vote to *strip* this authority from the federal courts.
This would put sharp teeth in it: “Arbitrate fairly or lose your authority to arbitrate!”
More than that the Rs should looking at rulings by judges that have no basis in constitutionality or law and begin impeaching such judges at any level.
