Civil asset forfeiture is one of the worst things we do, and the fact that most people don’t know or care about it is an indictment of our society. We can never resume being free until this is done away with.

There is a place for civil asset forfeiture in the law enforcement tool box but as it is implemented these days begs for reform. IMHO any CAF action should be approved by a judge before taken or if the action had to be invoked because of extenuating circumstances (target is fleeing), at least reviewed by a judge promptly after the fact.

Civil asset forfeiture is the practice by which law enforcement may take certain goods, including cash, if they are suspected to be tied to criminal activity.The word “suspected” gives the cops a gigantic opportunity to intimidate anyone they want to and for any reason, legal or illegal, that is convenient. This practice screams ABUSE and needs to be further defined or curtailed altogether.

In essence, she will have to prove a negative, and she will have to shoulder the costs for doing so, despite having already lost more than $100,000.All the more reason that in court proceedings involving a governmental entity all costs should be borne by the government which has an unlimited ability to tap its taxing power. Level the playing field!

and then Texas legislators should rip out the state's forfeiture laws by the roots.This has nothing to do with Texas laws. And very little to do with asset forfeiture laws.
