Doing this without first setting a national standard for what constitutes THC impairment behind the wheel is insane.
Thc isnt any more of a problem than alcohol except when its consumed. The courts will be backed up until they can get a legal limit imposed on how high someone is.
I can see 1000’s or millions of “dui’s” for people that just smell like marijuana. And..More court cases over an officers smell abilities.
Until you can define high, there is no use in legalizing it. My 2 cents.

Never imagined such a proposal coming from a “fascist, authoritarian” Republican.
In my neck of the woods more people are getting high behind the wheel instead of drunk, and I’m told it’s likely for these reasons: They know very well that driving while high is harder to prove than DWI, far more expensive to prosecute, and is even harder to get a conviction for unless the pothead kills someone.
So they choose to drive high rather than drunk.
Let’s hear it for legal weed.

It’s Drive While Impaired, not Driving While Drunk. If you can’t pass a field sobriety test, you are going downtown.

The more jurisprudence focuses upon the potential to commit offenses (”your so high you might hurt someone”) instead of actual offenses (”you hurt someone”), we can expect a deepening morass with liberty (and its attendant responsibilities) sinking into the same.
There should be a way to test a citizen for abilities to handle altered states of awareness and license them for carrying on with life without threat of punishment just for being “under the influence.” The punishment should be meted out swiftly and fairly if the citizen causes harm to body or property of his neighbor. That would incentivize responsible substance use. Most people these days have a conscience and go out of their way to be responsible without being told, just like most people stay on their side of the center line when driving.
Keep everyone mellow and it’ll be easier to bring in communism.
The stoned, like the ignorant, are far easier to rule.

And since THC stays in the body for at least 72 hours, it will be difficult to measure immediate numbers vs residual numbers.
I believe THC can remain in the body for weeks. The piss tests sailors take can pop positive for a long time after they have been smoking, as I recall.

There is; it’s called a field sobriety test. How accurate such tests might be is another matter.
I fully agree that the law should get away from restricting people based on what might happen rather than what actually did happen. The logical but absurd endpoint of prior restraint laws is that all people must be locked up because any of them might commit a murder.
So we need to implement a national police power?
There is presently no Federal actual prohibition of Cabibis.
President Trump allowed state to abrogate the Federal laws thus effectively eliminating them

No, the field sobriety test is conducted under suspicion, a refusal bringing punishment. Psychological and physical testing at time of license procurement, with waiver available so that the licensed citizen may drink, smoke, and drive all at the same time without fear of punishment for mere potential harm. Hurt or harm neighbor or property while under the influence, and punishment will ensue swiftly and fairly.
Except when one has a bona fide disability that precludes the results of a FST from being useful. FST assumes that one not under an inhibiting influence could otherwise pass.
Many folks cannot due to orthopedic or other disabling injuries.
Been there. Beat that. Now carry a letter from the VA documenting my athletic ability or lack thereof.

You do realize that almost everyone over60 cannot pass a classical roadside FST?
