I must be out of the loop because the first time I heard about The Eastman Memo was yesterday.

I did an internet search and this doesn't seem to have gotten much coverage which confuses me because this seems like something Democrats and their media would be ramming down our throats.

Has this Eastman Memo been discussed? Why aren't Democrats and their media hyping this story?

This is all ridiculous. Lawyers prepare memos for discussion of various legal theories.

There was no reason not to let the legislatures sort out what happened in their states or allow courts to hear cases. I don’t believe Pence could reject slates without competing slates in hand.

Bottom line I believe there was an organized effort against Trump that included some states violating the letter of their own election laws and deliberately poor record keeping, as happened here in Georgia. I am frustrated there appears to be no recourse pre or post election and the issue of standing as fig leaf for quick dismissal became a joke.

All that said, Trump lost because of Trump. I get that he doesn’t want to believe it but that’s objective truth. I am disinclined to support him in 2024 because of his behavior post election. The MAGA agenda was always more important than one man, and although he expressed that himself at rallies he clearly believes he is somehow indispensable and that simply isn’t so.

I am also tired of the daily deluge of spam fundraising solicitations. He’s acting like a spoiled child who didn’t get his way. It’s a damn shame because he has an important voice, a unique opportunity to be a voice of reason against the Biden agenda but he’s too much in his feelings to be effective and lead the loyal opposition

I read the Eastman memo.

I’m not a lawyer, but ConLaw is one of my hobbies.

If the premise “7 states have transmitted dual slates of electors to the President of the Senate” were TRUE, then the actions proposed for Pence to take would have been correct (leave aside the fact that the ensuing votes in the Special Joint Session, or in the House, would have elected Biden).

However, the premise “7 states have transmitted dual slates of electors to the President of the Senate” was always FALSE. The Republican State Legislatures of Arizona, Wisconsin, Michigan, Pennsylvania, and Georgia (I only know of 5) could ABSOLUTELY have appointed Trump electors and sent them in. THEY DID NOT DO SO. NOT ONE OF THEM.

Rump legislatures, in some cases consisting of five or six members, cannot “send slates of electors” anywhere.

The Eastman Memorandum, was a document produced in 2020 by John C. Eastman, an American law professor working with the legal team of then-President Donald Trump, intended to overturn root out the theft of the 2020 United States presidential election results with the purpose of getting Trump re-elected by throwing out electors from seven states on January 6, 2021, when Congress counted the Electoral College votes.

They stole the election, so now they are gonna accuse Trump of trying to steal the next one, so that if he should win, they will have their excuse for losing and for going after him nonstop it Investigstions
