German Employers Are Not Allowed to Request Workers’ Vaccination Status: Labor Minister

The German government rejected a suggestion on Wednesday that would give employers the right to find out whether their employees are vaccinated against the CCP (Chinese Communist Party) virus.

Hubertus Heil, the minister of labor and social affairs, said that Germany has strict privacy laws and employers cannot force workers to show such information, although he agreed that pragmatic solutions are needed for places that are at a greater risk of transmitting the CCP virus, such as hospitals or prisons.

“We must act according to the rule of law. Acting under the rule of law means that an employer is not entitled to information about health data…[and] is also not allowed to look at the medical records of an employee, because this is very personal data,” Heil said while speaking to broadcaster ARD, RT reported.

Regarding places that are “at a greater risk,” it is likely that employees will have to show, in the future, that they have either been vaccinated, recently tested negative, or recovered from the CCP virus, although no such law has passed yet.

However, exemptions to Germany’s privacy laws were made in August to allow restaurants to reopen, with staff and customers required to show that they are vaccinated or recently tested negative.

Heil’s remarks do coincide with an agreement from the cabinet on Sept. 1 that ruled employers must allow their employees time off to get vaccinated. Companies deciding on those measures could take into account the vaccination status of their staff if they knew it.

Citizens of the EU countries have far greater privacy protections than we do here.

(There's something about enduring fascism and communism that makes one insistent about certain things.)

I need to move to Germany. My employer has made it mandatory that all employees get the jab. I have until September 13 to get prick 1 and October 18 to get prick 2. In good conscience, I cannot take a vax that was developed using the cells of murdered pre-born babies, and I have no faith in mRNA vaxes. It is not good to mess with God’s genetic plan and ESPECIALLY not good to gain, based upon the death of an innocent, pre-born child.

Since I lost my house, wife, career, dogs, etc. a number of years ago, I don’t expect to do more than exist for the rest of my days In my current situation, I am likely better off financially to just declare bankruptcy, take the firing for not getting pricked, and just live off the welfare until pension kicks in.

Prayers requested, as far as making the right decision on getting the vax or not.

This is window dressing. It’s kabuki theater. Employers can’t request vaccination status but they can ask that employees voluntarily provide their vaccination status. Those who are vaccinated are assumed to be okay with providing this information, and those who do not will be assumed to be unvaccinated.

I work for a multinational corporation, and this is playing out. We even have a large presence in Germany. They’re asking employees to voluntarily attest to their vaccination status. It’s all voluntary. You don’t have to do it... unless you want to set foot on one of their campuses. And if you aren’t vaccinated or don’t want to attest, you have to request an accommodation from HR. As of today, no one’s been officially granted an accommodation. So the assumption is that everyone on a campus is vaccinated. And anyone who is at home, isn’t.

See how this is starting to play out? It’s guilt by omission.

This isn't true, at least here in the US. (You're on the company property; they can demand this info. If you state that you will not get this shot, you have medical privacy that provides some protection; it doesn't mean that they can't fire you.)

This isn't true, at least here in the US.

At a Fortune 100 company I work for, I've been told HIPAA rules forbid them to ask directly--and they act as if that were so. They're very PC, so I'm sure they would ask while speaking through a proctoscope if they were allowed.

This is from HIPAA:

Employers are not prohibited from asking their employees if they have been vaccinated against COVID-19 and there are no federal laws that prohibit an employer or business from asking for proof of vaccination status. If an employer asks an employee about their vaccine status, the employee can refuse to answer, but there could well be consequences.
