You may be correct and that is certainly the argument of those who fear a CC. I haven't researched the issue but the pro argument is that the issues are limited to what the majority of the states determine. If we take back the House and Trump is named the Speaker the matter seems less precarious; while what we are presently looking at is likely satisfies a full definition of the word.
