It’s called “prosecutorial discretion”, they can do what they want. I was involved in a Domestic Violence case and had indisputable evidence (tape recordings) of my ex-wife attacking me and breaking other laws. My Attorney, and many others in the legal filed all told me she should have been charged. Unfortunately, my estranged daughter is a Prosecutor and coerced the guy who Prosecuted me not to file charges against the my ex. Bottom line, the legal system sucks and is in great need of repair.
