A court cannot arbitrarily grant what the Constitution does not allow for. Rep. Gohmert is usually of sound mind, but someone gave him some terrible legal advice here.

Amen! Pence has exclusive power as President of the Senate to decide which Electors are valid. In fact, it would be dishonest of him to accept electors who’d been selected by anyone other than the representatives in that state; not by the shady governors of states where Dominion machines had corrupted the vote counts.

As should be the norm but isn’t, every elected official serving in any capacity in any political party should do what the constitution tells them to do, uphold the constitution. It’s a very simple concept. This should be the answer to every question.
Someone pointed out that this lawsuit was filed knowing it would get tossed. Then Pence can do what he wants, just as the states have done with ignoring election laws.

4 got it right. He already has the ultimate authority. Thomas Jefferson used it. He should announce the Trump slate of electors for all the contested states. The dems will have to object. He can then overrule their objection or go into the 2 hr session. When that ends without agreement between the houses, the Trump slate stands.
