“The fear is certainly understandable, because as I’m sure you know, martial law isn’t described or confined or limited, proscribed in any way by the Constitution or laws,” Bill Banks, a Syracuse professor with an expertise in constitutional and national security law, told Military Times. “If someone has declared martial law, they’re essentially saying that they are the law.”

What is ‘martial law’

In short, martial law can be imposed when civil rule fails, temporarily being replaced with military authority in a time of crisis. Though rare, there have been a number of notable U.S. cases where martial law came into play, including in times of war, natural disaster and civic dispute — of which there has been no shortage in 2020.

While no precise definition of martial law exists, a precedent for it exists wherein, “certain civil liberties may be suspended, such as the right to be free from unreasonable searches and seizures, freedom of association, and freedom of movement. And the writ of habeas corpus [the right to a trial before imprisonment] may be suspended," according to documents from JRANK, an online legal encyclopedia.

Whitmer, Cuomo, Wolf and the rest of the Dem governors have been saying they are the law for the past 6 months, with full support from the corrupt media. So what the problem now?

I hope it doesn’t come to this but, if it is declared to quell post-election rioting, I think most Americans would support it for the sake of getting control of our cities.

Donald Trump declaring martial law would be the least of my worries as he does not strike me as someone who wants to be in that position, however a President Harris with such power would be absolutely frightening.

They did.
Obama totally flouted the constitutional rights of Boston citizens without as much as a squeak from the media
More recently, when those two killers escaped from jail in upstate New York, Cuomo totally flouted constitutional rights of everybody in the search for those two killers.
The Dems have proved over and over again that they have no respect for the constitution or the law.

Frankly, I’d love to see a lot of “journalists” arrested and
charged with a crime related to lying to the public for
political gain.

From 2017 on, we’ve had papers printing things they knew
were lies over and over an over again.

That was my initial take on it also.

Some will have to happen if all hell breaks loose after the election though.

This terrorism can’t be allowed to continue unchecked.

Assuming Trump wins, it seems there is a very good chance that riots will erupt in big cities all over the country. If the states can’t or won’t maintain law and order, then it’s possible the feds might have to.

My question is, would invoking the Insurrection Act be the same thing as declaring martial law? It seems like it would be. And can martial law be declared without following the requirements of the Insurrection Act? I take it that the Act is the legal means a president has for declaring martial law. It sounds better using the term Act instead of “martial law.”

By the way, current Def Sec’y Esper has already declared publicly that he would not follow any orders to pit troops against American citizens. I think it should be avoided if at all possible, but if all else fails the president may have no choice.

My from personal take, if re-elected, Trump should open up a can of whoopas* and remove/fire a sh*t ton of people, Wray, Esper, etc., etc., etc., and then move all the rioting to a Federal level then crush them all with US Marshall’s, etc. even if he needs to invoke the Insurrection Act. With no further election looming for him, he should just go apesh*t on the Left, far Left, and these Anarchist Marxist Socialist thugs.

I mentioned such cause Trump does not necessarily have to invoke Martial Law or the Insurrection Act to crush these Leftist thugs reign of terror. Trump has proven he can do as much in some cases so far.

Would someone please explain as to how Trump would be able to declare martial law on the entire country of 320 million?

The answer is he cant!

If you add up all the military,cops(federal,state,city, mall rent a cops and the local dog catchers) then add a couple million more to make sure you didnt miss any you still only have around 10 million.

10 million cannot control 320 million pissed off citizens.

Remember all the military personnel are not trained to bust down doors and kick ass. They are for logistcal support like cooks, mechanics, admin types.

Then the number of door kicking take names and arrest of that number has to be divided in half since you cant work these folks 24hrs a day. Try dividing by 3. 1 shift on,1 shift off and the third resting up/recharging.

If things get that bad how many of these types will even report for work/duty? Planes cant fly without many hours of maintenance done. If the planes mechanics decide to go awol or stay home to protect their families the planes dont fly,PERIOD!!!

IMO, this is the reason why the military brass told the DEM-TURDS leaders that the military would not be removing Trump from the White House on Jan. 20th, 2021.

You may have some martial law in some small areas but it will not be widespread.

This point becomes stronger when you factor in all the guns in private citizens hands. If just the people who consider themselves as hunters steps out of the shadows that 10 million stated above will piss their pants and run for cover.

Please pray this does not get to that level. That would get ugly, very ugly, very quickly.

This is why the military brass took the position of telling the DEM-TURDS that they were staying out of this pissing contest.

Even in a small area or say a major city like DC,NYC or LA my point is the military doesnt have the manpower, equipment and training to enforce martial law.

The military is best at taking people out not babysitting a bunch of libtards pissing and moaning about how bad they have been treated in life.

Its a no brainer as to why they dont to be a part of removing Trump from the White House.

Maybe we will now get to get see those numerous FEMA camps that everyone was squealing about a few years back. The prisons are overfowing now so they cant go there
