Over 60 prosecutors, AGs say they will not criminalize abortion if Roe v. Wade overturned

Over 60 local prosecutors and state attorneys general issued a joint statement Wednesday saying that they will not enforce laws criminalizing abortion if the Supreme Court overturns Roe v. Wade, the landmark 1973 decision that first legalized the procedure.

The statement comes amid the Senate confirmation hearings for President Trump's third Supreme Court nominee, Amy Coney Barrett. If Barrett is confirmed the court would have a heavy conservative tilt and Democrats have sounded the alarm that Roe v. Wade could be overturned.

The 63 prosecutors in the joint statement took aim at state laws looking to curtail abortions as well as the prospect that Roe v. Wade may be scrapped altogether in the near future, noting that while they shared different personal opinions on the procedure, they felt curbing access to abortion would criminalize health care decisions.

“As some elected prosecutors have noted, the broad restrictions in the laws passed by these states appear to be unconstitutional under Roe v. Wade. Many of us share those legal views, but our commitment to not prosecute women who obtain abortions and health care professionals who provide treatment is not predicated on these concerns alone – and, indeed, would hold even if the protections of Roe v. Wade were to be eroded or overturned,” they said.

“Not all of us agree on a personal or moral level on the issue of abortion. And not all of us are in states where women's rights are threatened by statutes criminalizing abortion. What brings us together is our view that as prosecutors we should not and will not criminalize healthcare decisions such as these – and we believe it is our obligation as elected prosecutors charged with protecting the health and safety of all members of our community to make our views clear.”

It is still a STATE issue. That is the point of overturning Roe v. Wade. It should never have been a federal law. It is unconstitutional. Let the States make their own laws, as the Constitution has stipulated.

So if DAs and prosecutors don't have to follow/enforce the law as they pick and choose, why can't I pick and choose which laws I have to follow or not?

I agree 100%.

Somebody at the Hill was evidently never taught the differences between legislative powers and the edicts of tyrant judges.

Also, the pro-abortion policies of 60 prosecutors and AGs may not be in effect after the next election, depending on what taxpayers feel about the murder of unborn children.

And speaking of the next election, send "Orange Man Bad" federal and state government desperate Democrats home in November!

Supporting PDJT with a new patriot Congress and state government leaders that will promise to fully support his already excellent work for MAGA and stopping SARS-CoV-2 will effectively give fast-working Trump a "third term" in office imo.

I don’t see any problem with voting Republican ticket for 2020 elections.

Democrats think judges should make laws and that prosecutors should decide which ones to enforce.

Of course they do. That's why 90% of this summer's rioters who got arrested were released with no charges filed. The local and state prosecutors refused to prosecute BLM/Antifa rioters.

It is still a STATE issue. That is the point of overturning Roe v. Wade. It should never have been a federal law. It is unconstitutional. Let the States make their own laws, as the Constitution has stipulated.

You do realize that Roe v Wade was brought on a State law, right? Some chick wanted to kill her kid, so she tried to claim rape, but Texas didn't allow an exception for children conceived from rape, only in cases where the life of the mother was an issue. It's not a Federal law, it's a Federal court decision that killed many State/Fed laws, and even more kids.

The thing is, it still can be a Federal issue. While most laws for murder are State-based and State-prosecuted, the only Federal ones that would apply would be if the kid was conceived in rape (18 U.S.C. Section 2248, 2251), or, unless the abortion was completely free: Murder for Hire (18 U.S.C. Section 1958).

Women were never, or at least almost never, prosecuted for getting abortions prior to Roe. They went after the abortionists and people who worked with them.

My whole point was that it will still be a State issue, regardless if Roe v. Wade is overturned, or not..The idea that overturning will mean that every pregnant girl in America will have to go to her closet and use a coathanger, as Ted Kennedy suggested, is absurd, but the Demcrats are sticking to that mantra.

Well, that it isn’t the end of the argument is part of the deception on the left’s side. If Roe v. Wade is overturned, it simply means that the legitimate process of discussion becomes allowed.

Most states who will allow abortion will not allow it to the extent Roe has. Washington state, which is the most godless in the nation, had a quickening or heartbeat abortion law.

With Roe the legislators have pushed abortion all the way to abortion even after birth being legal.

While prosecutorial discretion does exist, it’s for individual cases and not a class of cases. The prosecutors’ obligation is to enforce the law by prosecuting violators.

The Fifth and Fourteenth Amendment prohibit abortion.
