“All of them realize leaving a 4-4 court in place is dangerous and not what our forefathers intended.”

The first supreme court had 6 members.

The first Supreme Court were all Christians, it at least had a Biblical worldview for the understanding and interpretation of the constitution. Such a different polarized America now.

The first supreme court had 6 members.

IMHO, we need a constitutional amendment going back to the original six.

Having only six Justices requires a 2/3 majority for the Court to do anything. If they cannot reach that level of consensus on an issue then it should go back to the courts of appeal until they can.

Didn't realize that. Thanks. 9 justices has been the number since 1869....151 years.

55 Men and the Constitution by Rodell tells us that they had a problem with the USSC in that there was no check. Perhaps the odd number has been an attempt to instill a check.

And tell Roberts that the Court is indeed a Political entity. And while the life term was supposed to keep influences away...it hasn't worked.
