Thanks for posting a link to the text of the speech. Reading through it, it is fairly clear that what he was really speaking about here was the practice of attempting to turn policy differences into criminal acts, by being ‘creative’ in one’s interpretation of the law.

Yes. This is an issue, and a real one. It is very dangerous an destructive when the State can take vague and poorly written legislation, and turn them into weapons of political retaliation. One of the strengths of a Republic is that one can participate in the electoral process, and not have to worry about your opponent coming back after winning to attack you with the full power of the State to put you in your place, and eliminate you as future competition.

However, what this is going to be interpreted as, by the hyper-partisan culture that now inhabits all levels of government is that actual crimes committed by the previous administration are going to be brushed off as mere partisanship, and thus off the table.

Any excuse not to move forward will be an excuse.

And you can be damned sure that if the Democrat party seizes power, that it will be open season to punish any political opposition they perceive.

In other words, protect the swamp.
