Court determines secret videos can’t be used in Patriots owner Robert Kraft’s massage case

A Florida appeals court ruled Wednesday that police violated the rights of New England Patriots owner Robert Kraft and others when they secretly video recorded them paying for massage parlor sex acts, barring the tapes’ use at trial and dealing a potentially deadly blow to their prosecution.

The state 4th District Court of Appeal ruled Kraft's rights were violated under the Fourth Amendment to the Constitution, which protects against unreasonable searches and seizures.

“The type of law enforcement surveillance utilized in these cases is extreme. While there will be situations which may warrant the use of the techniques at issue, the strict Fourth Amendment safeguards developed over the past few decades must be observed,” the judges ruled.

“To permit otherwise would yield unbridled discretion to agents of law enforcement and the government, the antithesis of the constitutional liberty of people to be secure against unreasonable searches and seizures,” the court added.

State deputy solicitor general Jeffrey DeSousa argued that police and prosecutors need the recording to convict the owners of felonies. The owners must be shown receiving payments from the prostitutes and the only way to get that is to install cameras, he said.

He said detectives had to fully record all massages, because the sex acts happened at their conclusion and 95% of male customers received one. While no female customers paid for sex, they were few in number and to not record them could be seen as discriminating against men, he said.

NFL owner Robert Kraft isn’t the only prominent name—or billionaire— snagged in a Florida prostitution bust.

Others named in the sweeping sex sting include billionaire Wall Street financier John Childs, as well as a former Citigroup president and a president of a Florida Boys and Girls Club, according to reports.

At the same time, WPEC-TV reported Friday that the probe also nabbed three former law enforcement officers in Indian River County.

I think the state paid a lot of money to prosecute this case, which I doubt was worth it.

Wouldn't this be a violation of the 4th for the massage parlor and not Mr. Kraft? Why would Mr. Kraft expect privacy at a massage parlor known for having pros at?

Of all the uses of law enforcement time and money, this has to be among the lamest. I don’t care if an old man chooses to pay for sex with some old women. I think it’s sad that all of them are in this position in life, but they certainly aren’t harming me or anyone else. Crack down on Antifa and all of the rioters, and leave the old people in peace.

If the government could do this they could put cameras everywhere, in private places, and then just sit around and wait for crimes.

Store enough data and you’ve got a history. Then, if you come onto their radar, they can just scroll through your past and see when you’ve littered or spit on the sidewalk or scratched your balls in public

Society in general seems to be ok with sex between consenting adults. As long as there are no minors involved this is just a routine prostitution case. I haven’t followed this one, is there any reason this is more than routine at this point?
