Judge Sullivan has asked the Circuit Court to grant an en banc hearing (hearing with all 11 judges of this Circuit). Granting such a hearing would be unprecendented in these circumstances, but the Court has not yet responded. Stay tuned.
Keeping Flynn twisting in the wind in all this while they examine their navels does great harm to his 6th Amendment rights in the Constitution.
