Request for en banc review by Sullivan. Let’s drag this across the Nov. finish line.
The Writ approved by the Court of Appeals officially takes effect after Wednesday so unless the full panel agrees to take another view on appeal, Judge Sullivan should be signing the dismissal later this week.
If he refuses, he would create a situation quite bad for himself where another filing by General Flynn’s counsel, Sidney Powell would request again that the case be yanked from Sullivan and given to another judge to sign the dismissal.
So, we’ll see what happens but the three panel Court of Appeals did not yank the case from Judge Sullivan as not to embarrass him.
Now we’ll see what happens.
