Though it would be politically explosive, they have until January 20, 2021 to confirm, even if Trump loses. I agree though, should have happened 6 months ago, or they need to suck it up and hope Trump wins.

This Senate would not confirm any Trump nominee at this point.

And after the bloodbath in November? I don’t even think they will be in session.

Actually, they have only until Jan 2 or whenever the first workday is in 2021. That is when the new Congress is sworn in. So, if the dems take over the Senate, it will be vicious. Thomas has said he won’t retire. I was hoping both Thomas and Alito would have retired last year, but with the republicans inability to pick truly conservative justices, it may be for the worse.
