By "appeal" I think the author means ask for an en banc review by the Appeals Court. They may or may not grant that. I think the release of the Strzok memo and Flynn making the rounds of radio talk shows were intended to signal Sullivan that this would ultimately be futile.

I believe he is a party in this action. He is essentially the defendant in the special suit brought against him by Flynn’s lawyer (Powell), in which she asked the appellate judges to order him to dismiss the prosecution of Flynn.

I’m with you, he’s not a party to the case. The only reason he had an advocate in the case because of the defense appeal.

Apparently he can request that it be reviewed by the entire circuit - “en banc”. Since there are more rats on the entire circuit he might get what he wants.

Of course - this is insane and obvious to all what’s going on. The Obama persecution of Flynn.
