Maybe, maybe not. But you cannot claim protection on one hand as just a publisher, than claim on another hand to be a platform. Something has to give.

If they pick and choose what gets published or spoken, then they can be held liable for for their users “defamatory, fraudulent, or otherwise unlawful content”.

Don't get me wrong, these tech companies have too much power and they're using it for evil. Anti trust applies as does stripping their immunity from libel suits (i.e. remove their status as a neutral platform). They need to be reigned in.

I'm just saying that the Dems are already using the Flynn thing to subpeona DOJ malcontents to say stuff that makes Trump look bad, now they'll bring in more to say Trump's tweets made DOJ pick on a poor little company just trying to make a living in a harsh, cruel world. And they'll cray and wail about how unfair orange man is and here come Abuse of Power Part II.
