Unfortunately, “perceived sex” or “transexuals” are not written into the Civil Rights Act.

When being literal for your basis, I fail to see how anyone can read these terms into the word, “sex.”

Precisely my point. Since the words are not in the Act that Congress passed, only Congress can add those words to the Act, and if the Judiciary adds the words it is violating the separation of powers.
