There is a single uncut unedited video taken from six feet away showing the ex-policeman keeping his knee on the neck of an unconscious man in handcuffs lying down in the street, for a two full minutes AFTER one of the other policemen who had been holding him down, says he has no pulse.
He doesn't even double check for a pulse. He doesn't start CPR.
On someone over whom he has assumed responsibility ("in custody" implies a duty to protect his life a that point.).
If the dead man had been an Al Qaeda terrorist, the Marines would have been court-martialed for this.
He had already completed his sentence for his prior crimes; at the moment he had been accused of passing a bad $20, which is not an imminent threat to life or limb.
So deadly force was not necessary; still less after he's in cuffs on the ground, first unconscious, then with no pulse.
There are store security videos which show him peaceably talking with the police with his hands behind his back as they stand him up and walk him to the squad car. And the Statement of Probable Cause against the officer (due process) says that the dead guy became compliant after the cuffs were on.
Hear that? The State itself said so. Not some BLM rabble-rousing lawyer, three weeks later.
If the dead man had been convicted of murdering a 3-year old, the Courts would have ruled this cruel and unusual punishment. That video, is the dictionary definition of depraved indifference.
Which is what is required for Murder 3 in Minnesota.

The handcuffs mean the police are now his custodians and responsible for his safety ("custodian" as in "in custody.")
No CPR on a man you took into custody, when he passed out while your knee was on his neck, and now one of your fellow COPS just told you on camera in front of witnesses that he doesn't have a pulse?
That is all that is necessary to convict.

Sorry, even one of the other officers disagrees with you and told the perp-officer his action was unnecessary and wrong. It was easy for the DA to quickly indict the officer. The police have been told not to use such a maneuver, that it is dangerous.
Forensic toxicology tests take days if not weeks, so how could the Hennepin County ME have these results overnight?

Intent may not be. But you are also claiming depraved indifference.
Proving what was in the officers mind is near impossible and you know it. Even if a witness claims they have knowledge of the defendant making similar claims. It’s still their opinion, their perception. It’s why I expect his wife will be rolled out. Her testimony could be considered more trustworthy.
Assuming this tox report is correct and not much more mitigating material appears, we’ll end up with a manslaughter conviction.
