I'm defending civil rights.

There is a single uncut unedited video taken from six feet away showing the ex-policeman keeping his knee on the neck of an unconscious man in handcuffs lying down in the street, for a two full minutes AFTER one of the other policemen who had been holding him down, says he has no pulse.

He doesn't even double check for a pulse. He doesn't start CPR.

On someone over whom he has assumed responsibility ("in custody" implies a duty to protect his life a that point.).

If the dead man had been an Al Qaeda terrorist, the Marines would have been court-martialed for this.

He had already completed his sentence for his prior crimes; at the moment he had been accused of passing a bad $20, which is not an imminent threat to life or limb.

So deadly force was not necessary; still less after he's in cuffs on the ground, first unconscious, then with no pulse.

There are store security videos which show him peaceably talking with the police with his hands behind his back as they stand him up and walk him to the squad car. And the Statement of Probable Cause against the officer (due process) says that the dead guy became compliant after the cuffs were on.

Hear that? The State itself said so. Not some BLM rabble-rousing lawyer, three weeks later.

If the dead man had been convicted of murdering a 3-year old, the Courts would have ruled this cruel and unusual punishment. That video, is the dictionary definition of depraved indifference.

Which is what is required for Murder 3 in Minnesota.

I wouldn't be surprised if there were a number of them on this thread.

Thanks for the common sense. The problem with black criminals and just the stupid semi-pros is they always resist arrest. They are not right in the head, but this is what makes them lo-IQ dufus crims in the first place.

Any white cop, anywhere, at any time can have his career killed by an encounter with these maggots and useless eaters/ And the good Lord will assure the money grubbing family will be lined up SUPER-STAT! to cash in with the help of the black supremacist lawyers like Crump and his outfit.

Minnesota is as far left as you can get and will never do what is right. In Minnesota, the state is the enemy of law qand order in favor of all sorts of approved criminal action

Civil Rights? What about the cops civil rights to safe and enjoyable employment?

Not when they have the policeman on a live, unedited, on the spot, as it happened, video from six feet away, keeping his knee on the neck of a handcuffed man passed out on the ground, for two minutes straight, right after one of the other cops who had been holding him down tells him the victim does not have a pulse.

The handcuffs mean the police are now his custodians and responsible for his safety ("custodian" as in "in custody.")

No CPR on a man you took into custody, when he passed out while your knee was on his neck, and now one of your fellow COPS just told you on camera in front of witnesses that he doesn't have a pulse?

That is all that is necessary to convict.

Intent is not an element of 3rd degree murder under Minnesota state law.

Of course it does. It may have been an improper response, but it obviously explains why a more drastic response was employed.

Sorry, even one of the other officers disagrees with you and told the perp-officer his action was unnecessary and wrong. It was easy for the DA to quickly indict the officer. The police have been told not to use such a maneuver, that it is dangerous.

Forensic toxicology tests take days if not weeks, so how could the Hennepin County ME have these results overnight?

You’re trying way too hard to make your case counselor.

Intent may not be. But you are also claiming depraved indifference.

Proving what was in the officers mind is near impossible and you know it. Even if a witness claims they have knowledge of the defendant making similar claims. It’s still their opinion, their perception. It’s why I expect his wife will be rolled out. Her testimony could be considered more trustworthy.

Assuming this tox report is correct and not much more mitigating material appears, we’ll end up with a manslaughter conviction.
