If there is one positive that might come out of this nonsense its that AG Barr may be forced to directly put specific details of corrupt behavior by the Mueller prosecutors in a response. The DOJ has attempted to retreat from the Flynn case without calling out, and directly identifying, corrupt DOJ activity. Perhaps that will change "
DOJ was invited to provide a brief, not ordered to. The only reason Barr made his minions drop charges was to stop more facts of corruption in his department from coming out. It was just getting to be too much so he said enough, let him walk and let this all go away.
There is no way he now voluntarily discloses any additional acts of corruption from within DOJ or emphasizes the ones we already know. He was trying to bury all that in the first place! He'll just decline to respond or issue a half hearted hand waiving brief and let the judge screw Flynn.
This is my prediction, we'll see soon enough if I'm right.
If Sullivan were to sentence Flynn to jail time because of his guilty plea, what is to stop him? Of course Flynn could appeal.
