Certainly appears so...
Did anyone expect Trump to call out the Marines to counter the Impeachment?
These are riots with the same places and people with which they always occur.
Trump should not get involved. Any failure would be on him when all of the responsibility is only at the state and local level.
Governors and mayors will be justified in seeking damages from the US government when Trump gets in it.
No to that!
I want him to destroy Facebook and Twitter.
Yes! REGULATE facebook. I want that twerp Zuckerberg put under the microscope.
I agree! We have been asking for this for a long time. Twitter and Facebook just can’t behave. What is worse they are totally dishonest about it.
So he let’s the White House Burn?
A federal officer was killed also.
Federal buildings attacked.
Etc.
I read the entire EO. Section 230 gives these social media platforms exemption from liability for anything posted on their platforms, because they are neutral, and a valuable public service is performed by them facilitating free and open discourse. The EO provides that if they start mixing into the discourse, censoring opinions they don’t like, posting fact-check notices selectively, etc., they lose the exemption conferred upon them by Section 230.
The courts may restrict this EO, and rule that they only lose this exemption with regards to the opinions that they post, or the posters that they censor.
But nothing that I read in the EO further punishes the platform owners for interfering, other than getting no more federal ad money, and having the government snooping around to see if they’re doing something to censor viewpoints via algorithms. It’s all about fairness in managing a public forum, and exemption from liability so long as they are fair.
Again, which specific power is enumerated in the Constitution that gives the feds the power to interfere with private individuals or corporations? You can’t find it because it’s not there.
Nowhere does the Constitution give the feds this massive sweep of power.
The feds are now a mostly unconstitutional, and thus, mostly illegal totalitarian power. America’s greatest threat is not China or the Man in the Moon. America’s and American’s greatest threat to their freedom and peaceful way of life is their own massive $4 trillion federal government.
Congress is the one who granted a privilege to this particular class of corporation. The federal government can put conditions on the privilege it granted. The Common Law makes individuals liable for slander, defamation and libel in anything that they publish. Congress statutorily exempts social media platforms from that liability. The EO conditions that statutory limitation on fair administration of that platform. Once they show bias, they are no longer an administrator of a platform within the intent of 230, but a publisher, subject to civil suit under the Common Law. Common Law officially started in the 13th Century, but goes much further back to Roman, Greek and Talmudic sources. Under the Constitution, it can be altered statutorily. Under this EO, the statutory limitation of the Common Law liability is explicitly qualified and contingent on the fair conduct of the platform.
Your entire premise is flawed. This is not an interference in any private individual’s affairs, unless you deem Section 230 itself an interference under the same standard, in which case social media is finished forever, and Mort Zuckerberg, et al., had better tell Ian Musk to hurry up and get them to Mars.
Speaking of FB-
I have an account. I have everyone silenced on it and I have to actually visit their individual FB pages if I want to know what is new with them. The only things I get live feeds from are groups of which I am a member. There are several art groups and my favorite, golden retriever owners groups.
A new trend that has started in the past 24 hours is people suddenly putting hateful political messages ALL OVER every group! Things started showing up on the art pages but sooner or later, it is going to be on the golden retriever pages too, I’m sure!
I have had to radically adjust some settings this week! I’ve had to simply unfriend so many liberals who I had always had an “agree to disagree” mindset with. They, of course, are in full support of the rioting and making excuses for it. Of course, none of the violence has hit their homes or loved ones.
