I would say the shooter's own story proves he was brandishing it. He was allegedly chasing this guy to detain him. He claimed there was a string of burglaries in the neighborhood. That turned out to be a bald-faced lie. He also knew who this person was from his work.
He doesn't claim he didn't shoot him.
