An FD-302 is simply a report of what an interviewee said. In this case, two FBI Agents interviewed Flynn. The interview was not recorded. One of the agents present in the interview prepared a report (an FD-302). It is alleged that two people not present during the interview, Deputy Director Andy McCabe and Attorney Lisa Page altered that 302 that was prepared by the agent who was actually there. Sound more guilty is pretty important when its Flynn’s wors against the agents who interviewed him. If true, as it seems it is, that would be obstruction of justice in my opinion. McCabe and others need to prosecuted.
Those are all good points, but since Flynn signed a guilty plea two things happened: (1) the case never went to trial, so no evidence was presented in a court; and (2) he waived his right under the Constitution to see the evidence against him.
