The opinion was issued by the 10th Circuit Court of Appeals, located in Denver. It is a federal court. Just a clarification here that this was a 'panel' of the 10th operating (remotely) out of Salt Lake City. The logical 1st choice in the on-going process would be to petition the ENTIRE 10th Court ('En banc') for a decision before going to the 'Supremes'!
