Report: India’s H-1B Companies Ask Labor Department to Let Foreign Workers Stay amid Crash [Call to Action!]
Breitbart ^ | April 3, 2020 | Neil Munro

Posted on 04/04/2020 4:59:45 PM PDT by Reno89519

The India-based NASSCOM business lobby is asking the Department of Labor to help the lobby keep its huge workforce of Indian H-1B temporary workers in American jobs throughout the coronavirus crash, according to a report in the Times of India newspaper.

...

Labor Department officials declined to provide any information about the NASSCOM lobbying and declined to say if the agency would help businesses change the paperwork that allows fired H-1Bs to stay in the United States.

...

If the administration moves forward in relaxing regulations governing the H-1B program amid spiking unemployment, “get ready for the pitchforks,” said Kevin Lynn, founder of the U.S. Tech Workers group that opposes the H-1B program. “When people have nothing left to lose, they will lose it — and they will direct it at the elites. He continued:”

On March 27, a friend of mine was fired after giving an hour of “knowledge transfer” to her [H-1B] replacement who came from overseas. Now she’s unemployed at a time when ten million other Americans have filed for unemployment. She doesn’t get to participate in the American Dream. Instead of being a member of the middle class, she’s a member of the financially impoverished class. And in America, to be without a job means you’re out of the pecking order, you’re on the low run, and in American today, that could be years, if not decades. The pitchforks are coming out because people are nine meals away from revolution

There is much evidence that President Trump recognizes the sensitivities of this issue. On April 2, his deputies reversed a plan to import more H-2B blue-collar workers in the crisis. The sudden reversal came after an April 1 press conference where Trump dodged two questions about white-collar visa workers. [Winning!]

...

The H-1B is the largest of the many visa programs — OPT, H4EAD, L-1, TN, CPT, E-3, B-1, — which keep roughly one million Indian contract workers, plus more than 200,000 migrants from China and other countries, in a wide variety of white-collar jobs throughout the United States. Few of the H-1Bs are more skilled than American graduates, and most are rated as “Entry-Level” or “Qualified” workers in the H-1B process.

...

...companies and the media to pretend that the government agrees that no Americans are available to take the H-1B jobs.

[Lots of great explanation on LCA and H-1B fraud]

...

...20 CFR 655.735 rule says that the H-1Bs must be fired if they are kept at the alternative address for more than 60 days:

(2) Immediately terminate the placement of any H-1B nonimmigrant(s) who reaches the workday limit in an area of employment. No worker may exceed the workday limit within the one-year period specified in paragraph (d) of this section.

...

...companies do not want to lay off their H-1B workers because the law clearly says that laid-off workers must leave the United States in 60 days [Emphasis added]. If their workers are recognized as laid off, they exit the country and cannot be slotted back into their jobs as the economy recovers.

...[L1, B-1/B2 visa schemes to keep Indians in the US]

...

There is growing evidence on message boards, Twitter, and lawyers’ question-and-answer sites that many H-1Bs are being laid off by American and NASSCOM companies, alongside the American graduates who are being fired in the coronavirus crash.

...

In March 2016...Trump declared:

The H-1B program is neither high-skilled nor immigration: these are temporary foreign workers, imported from abroad, for the explicit purpose of substituting for American workers at lower pay. I remain totally committed to eliminating rampant, widespread H-1B abuse and ending outrageous practices such as those that occurred at Disney in Florida when Americans were forced to train their foreign replacements. I will end forever the use of the H-1B as a cheap labor program, and institute an absolute requirement to hire American workers for every visa and immigration program. No exceptions.

H1B workers being kept around while Americans are being fired. Today there is no shortage of Americans for any job in the US. It is time to end the program and send these millions of workers and their families home!

Call to action? Like the Trump administration reversal on H-2B workers on April 2, we need to speak up to make sure H-1B gets a similar boot.

Buy American, Hire American.

I highly recommend taking a few minutes to read the entire Breitbart article as it is quite detailed and informative.

I’ve been wondering when the people are going to get made enough to kick ass. They fear us much more than we fear them, I promise you. However, it’s hard to get people to believe that.

I wonder what the H1-B pimps on here will say now ... not that there ever was a real “labor shortage.” Labor shortage (at least in IT) was based on age discrimination. Put over 45 techies back to work... and poof there goes any shortage.

Yes, I am a 60 year old unemployed IT worker forced to work temporarily in an unrelated field. If we can end H1B and other visa programs, these jobs can once again be opened up to Americans of all ages—both us senior workers and new or recent graduates.

Pitchfork time. Lots of laid off and fired Americans. It will look very bad, for the country and for Trump especially if the remaining workers and first returning workers are cheap foreign labor via H1B and other visa programs.

I have not personally known a single H1-B worker. So I do not know why companies keep hiring them. My best guess is companies like those H1-B workers because they are cheaper to hire and most companies are about the bottom line over any loyalty to US citizens. The CEO’s are more afraid of stockholders than fired American workers.

Americans first. It’s a promise you made to American workers, President Trump. You owe nothing to Indian workers.

There are millions of us along with those fully employed 3 million h1-bs. Actually, there are far more here... many get citizenship or other visa types. They NEVER go home.

It’s not just about cheaper. Bad managers can abuse the hell out of them and get away with it. Additionally, now that this has been going on a long time... many former h1-bs are now in hiring roles. They are bigoted as hell towards non indians and hire their own.

I have a friend of Asian American (India) heritage who walks the very fine cultural line between being American and being Asian. She is constantly being torn between the two worlds and is often under a lot of stress because of it.

Her mother married her to a man from another country of Asian heritage so that he and his family who were all here in the USA illegally could stay via “chain migration”. His family is often violent and cruel because of her American tendencies & ideologies.

Now she is torn between the country where she was born and grew up (USA) and to illegal “immigrants” who don’t belong her but with whom she’s now married into.

I don’t care - there’s NO need for the H-1B visa - there are more than enough hands to do the work right here. Of course, now they’re shipping IT, administrative & other medical jobs offshore to them. For every ONE American worker, you can get 4-6 workers in India and the Philippines, followed by some other countries doing the same. No visa required.

H-1B’s bring over their fiances or wives on H4EAD visas and the H4EAD holder can start a business or work any jobs that Americans are qualified for so Americans are competing with the H-1B wives as well. Then they have a few kids who are anchor babies. Birthright citizenship needs to be ended and all H-1B’s, H4EAD’s , etc sent home.

Yep. I’m disappointed that Trump put a former H1-B lobbyist in this position. Hope he fires the guy. There are going to many many millions out of work in the next few months. Bringing in foreign workers will be a big issue in the election. Keep the Chadster on staff and many will just stay home. I know for a fact that the Trump campaign is active on this site. I hope they heed this warning.
