Agreed. Is this even legal? If the FDA, a federal agency, allows "off label" use of drug, can a state ban it? We have federal preemption in this country in this subject area. Each state doesn't have its own schedule of approved pharmaceuticals. It'd be a total mess if we did (e.g., X cancer drug is okay in Wyoming, but not in Oregon, etc.). Where does this guy get off doing this?

I agree. The Off Label use of this drug isn’t something that is under the control of any Governor. That is an FDA managed use.
