Judiciary Cmte. lays out 55-page report on constitutional basis to impeach Trump
The Washington Times ^ | Saturday, December 7, 2019 | Andrew Blake

The House Judiciary Committee on Saturday released a report addressing the constitutional grounds for impeaching President Trump as its members prepare to move the process forward.

Written by staffers for the committee’s Democratic majority, the 55-page report was issued amid Republicans including Mr. Trump continuing to cast doubt on the legitimacy of the ongoing impeachment inquiry threatening his presidency.

“Impeachment is the Constitution’s final answer to a President who mistakes himself for a monarch,” reads an excerpt from the report’s introduction.

Committee Chairman Jerrold Nadler, New York Democrat, said similar reports were prepared during the impeachments of former Presidents Richard Nixon and Bill Clinton in 1974 and 1998, respectively, but that they no longer reflect the best available learning on the subject and ignore several issues of constitutional law relevant to the inquiry into Mr. Trump.

“The Framers worst nightmare is what we are facing in this very moment. President Trump abused his power, betrayed our national security and corrupted our elections, all for personal gain. The Constitution details only one remedy for this misconduct: impeachment,” Mr. Nadler said in a statement.

“The safety and security of our nation, our democracy, and future generations hang in the balance if we do not address this misconduct. In America, no one is above the law, not even the President,” said Mr. Nadler.

“Impeachment is the Constitution’s final answer to a President who mistakes himself for a monarch,” reads an excerpt from the report’s introduction.

Dollars to donuts says the idiot lawyer for the Dems rehearsed her remark about Baron Trump to “fit the narrative” they’re trying to fabricate.

The act of Impeachment itself may be constitutional, but the process whereby these Leftist vipers have used TWICE (first time was the debouched Mueller investigation) to launch such proceedings is unconstitutional, lacking articulatable reason suspicion or probable cause to move forward. These clowns have made it easier to investigate the President than to get a traffic ticket.

These clowns are third-world dictators and those who are not themselves impeached, convicted, and imprisoned, should be given a one-way ticket to such places.

Processes used to support the impeachment:

Subpoenaing witnesses, colleagues, etc.:

Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The impeachment process is subject to this amendment also:

Amendment V
No person shall...be deprived of life, liberty, or property, without due process of law...

The impeachment process is subject to the 4th & 5th Amendments.

The Constitution trumps and has authority over ALL federal activity (U.S. Const., Art. VI, Cl. 2).

“High Crimes and Misdemeanors” are crimes no matter how they are defined. Amendment 4 & 5 prevail over the House here.

“This Constitution, and the Laws [or “Acts”] of the United States which shall be made in Pursuance thereof...shall be the supreme Law of the Land.”
U.S. Const., Art. VI, Cl. 2

The States and the People via the Constitution created and limited the feds. The feds ONLY legitimate power and authority is that which is delegated and enumerated by the Constitution.

Amendments 4 & 5 supervise the impeachment process which in this case is patently unconstitutional.

The only time those @$$holes even read the Constitution is when they were looking for loopholes....

Same with the Ten Commandments.

And they took 1984 as an instruction manual, not a cautionary tale.

1. Trump won the election.

2. He hurt our feelings.

That’s it! All the rest is filer. They could have done it in two lines instead of wasting 55 pages to try to justify it. Geez.

“The Framers worst nightmare is what we are facing...” False.

The document is dead on arrival. Sounds like the 1960’s anti-DDT crowd wrote the document.

Mental illness is strong among democrats, it is. Amazing how this supposed “King” has abided by every decision of liberal judges until they were overturned by the SC. A king wouldn’t do that. The Dems are pushing this country toward a hot civil war — which if it occurs, they will not win.

Silly me. I thought it was the answer for a president who did something illegal in office.
