One of the more startling developments of the House Intelligence Committee’s investigation into alleged wrongdoing by President Donald Trump regarding his Ukraine policy was that the chairman of that committee, Rep. Adam Schiff (D-CA), used his committee’s subpoena power to acquire phone records of another member of Congress.

I predicted this back on April 20, 2018:


The trap for Republicans is that Democrats know they can be abusive first and get away with it, because Republicans will reject "whataboutism," and insist on taking the high road in contrast, essentially giving the Democrats a free "kick me" every time.

Nothing will change unless liberals feel the blowback.


The net effect here is that Schiff gets the phone records of his opponents, and Republicans get kicked again.

Democrats have free rein to abuse Republicans, and they know it because they know Republicans are ultimate weak and feckless and won't punch back.

Adam Schiff uses a dark blackberry, with military grade encryption. IOW, there are no records.

Wrong. There are always call records. If you call a number from one phone to another, a CDR (call detail record) is cut. This will show, at the very least, the calling number, the called number, time of call, and duration. It will show the content of the call, but the metadata involved is still extraordinarily useful for intelligence services.

it’s likely that Devin Nunes’ phone records were NOT obtained through that Schiff subpoena. All indications are that Nunes showed up in those records because he was placing or receiving calls to someone else whose records WERE obtained.

From the WSJ via Townhall:

Adam Schiff’s 300-page House Intelligence impeachment report doesn’t include much new about Mr. Trump’s Ukrainian interventions. But it does disclose details of telephone calls between ranking Intelligence Republican Devin Nunes, Trump attorneys Rudy Giuliani and Jay Sekulow, reporter John Solomon, former Giuliani associate Lev Parnas, the White House, and others. The details are “metadata” about the numbers and length of the calls, not the content...

Our sources says Mr. Schiff issued a subpoena in September to AT&T, demanding call logs for five numbers—including Mr. Giuliani’s. Subsequent subpoenas to AT&T and Verizon demanded more details. Republicans were told of the subpoenas, yet under rules of committee secrecy couldn’t raise public objections.

It's interesting that "five numbers" resulted in snaring Nunes, two of President Trump's lawyers, Giuliani's investigating partner, and reporter John Solomon.

Linda reminds me of another recent South Carolinian in Congress, Trey Gowdy. Lots of bravado and threats of what they are going to do but when it comes down to it, well lets just say I could eat a bowl of nasty chili and fart in a congressional committee room and get more of a response than these two thus far.

If they did subpoena and got Schiff’s phone call records, they’d find a lot to “Studs R Us”, “The Hard Hot Line”, and “I Love Poles”. I don’t think this is a “SARC” item.

Lindsay absolutely makes perfect sense. This must never become a part of oversight, going after each other’s phone records. As my Mother used to say, 2 wrongs do not make a right!
Now, did anybody else pick up on what he was saying?

Now, if some investigative body outside of Senate oversight wants to do it, that’s up to them.

But when House members and Senate members start subpoenaing each other as part of oversight, the whole system breaks down.”

That was a great hint to independent investigative groups like Judicial Watch who have done amazing things to get documents out there to the public.
