Nope. It’s distracting you from driving, even drinking water or any other type drink. In the UK this woman was ticketed by one of those traffic wardens when she took a drink of water while stopped waiting at a traffic signal.
It would be illegal if you have fries with it and are dipping the fries in ketchup. /s
