Lin Wood @LLinWood As predicted, today Judge Bertelsman entered an order allowing the Nicholas Sandmann case against NBCUniversal to proceed to discovery just as he had earlier ruled with respect to WaPo & CNN cases. The same judge has ruled in similar cases against CNN and NBC, and allows the cases to move forward on the same basis as the WaPo case. (Click for pdfs. the CNN Order and NBC Order.)
As to CNN, the Court ruled:
As in the Washington Post case, the Court believes that discovery is necessary to determine what happened in the unfortunate events which give rise to this litigation, and, to determine whether defendant accurately reported them, and, if it failed to do so, whether the failure was due to negligence or malice. Naturally, following a sufficient period for discovery, these issues will again be reviewed at the summary judgment phase under a more stringent standard.
As to NBC, the Court ruled:
Therefore, as in the two related cases, the Court finds that the statements that plaintiff blocked Phillips or did not allow him to retreat, if false, meet the test of being libelous per se under the definition quoted above.
As can be seen, in all three cases the only surviving claim is as to the allegation that Sandmann blocked Phillips. Thats a narrow issue on the surface, but its an issue Sandmanns lawyers could drive a truck through because they get discovery of the entire news process that led up to the reporting and who knows what they might find that would allow for trying to reinstate the other claims.

From what I heard Nick has the best legal team handling his suit. They have a high batting average righting the wrongs done by libel.

Video shows it is false. Phillips approached Sandmann and got in his personal space. Sandmann simply stood his ground.
He was supposed to cower and offer reparations from his wallet.
No man's life, liberty, or property are safe as long as court is in session.

Good. What they did to that young man and his friends was despicable...
One good and one bad thing here. The bad is that the judge is a Jimmy Carter appointee who simply won’t retire. The good is that the jury will be from Northern Kentucky, not exactly Hillary country. I’d be pretty scared Shiiteless if I were the media trying to defend their own actions.
Thank God! Finally we get a hint of justice against one of the darkest forces ever put together in this country, the leftist media. Their goal is to break this nation down because they want no morality or belief in God to exist, for then, no one could oppose their actions. When they have no qualms about using lies and fiction to destroy the live of children, someone in power needs to take the risk of exposing them. This lawyer and this judge are doing that and many of us out here feel relief and gratitude that the media mobs have not yet succeeded in taking over.
It’s the only way to make them stop publishing crap before they really know what happened.
