The liberal judges think that it is unlawful for Trump to use an Executive Order to rescind an unlawful Executive Order by Obama. Yep, that is the reasoning of the self-proclaimed “wise Latina.” Liberals simply do not care about the rule of law. They care only about how they can manipulate their “living Constitution” to meet their policy goals. Disgusting!

How can they not? One president cannot write an executive order, or memo, or whatever it was, that another president cannot rewrite or undo. That’s not the way laws are made in our system of government, and if the bleeding hearts have a problem with the hardship it will cause, they should take that up with the Democrats.

Trump does not need to “rescind” DACA.

The “D” in DACA stands for “Deferred Prosecution.”

Three years ago, Trump could have written an Executive Order to the Secretary of Homeland Security and ordered him to remove all persons illegally present in the USA.

Trump’s authority derives from the Immigration and Nationality Act of 1952 - and the 70 years of settled law that have followed it.

By the way - for those who have not heard, Trump just appointed Chad Wolf as Acting Secretary of Homeland Security.

Among Chad Wolf’s immigration achievements - he was a registered lobbyist for H-1B visas from 2016-2017.

I expect Roberts to use this, just as he reasoned that Trump had the authority to include a citizenship question on the 2020 census, but the administration needed to better explain to Roberts “why” and how they made decisions.

Same will likely be ruled here, that Trump has the authority to end DACA, but hasn’t given a good enough reasons. Apparently, Roberts has the authority to second guess all of Trump’s decisions.

They had better support the president’s DACA termination EO, otherwise they had shown themselves enemies of the US constitution and the primary separation of powers doctrine. Presidents and their administrations execute laws, not create them. If DACA is declared a law, them we have a monarchy??? If DACA is a “policy” then it is subject to oversight and action by both administration and or congress.

What would be great to see is that EOs on their face are eventually declared extra-legislative and non-binding to anyone but the minions of the administration.

So frustrating this issue is even at the SC. A memo written by a bureaucrat creates a law so potent it can only be reversed by rule of the SC.

That is as unconstitutional as banning guns.

This is the BS rationale Roberts used to overturn the EO and regulations regarding Census questions.

I don’t think ANY rationale is needed for Executive Orders. As far as I know, the Court never overturned an Obama executive order because it didn’t have enough paper justifying it.

Roberts has been a consistent enemy on immigration issues with this bullshit procedural stuff. I would expect the same from him although I would just prefer that he admit that he thinks open borders are a great idea and that he will twist his opinions to achieve that result, regardless of any constitutional or legal basis for his opinion.

Francisco was repeatedly questioned as to why the administration has justified ending the program because of its purported unlawfulness instead of giving other reasons for why it wants to.

That is the dumbest sentence I've read in a while. "Little Johnny, you say you don't eat peanuts because they make you break out and stop your heart from beating. Why can't you give us other reasons why you don't eat peanuts?"
