Democratic sweep in Virginia gives new life to the Equal Rights Amendment

(CNN)The coming Democratic takeover of the Virginia legislature has cleared the path for the state to ratify the Equal Rights Amendment, which would ban discrimination on the basis of sex and guarantee equality for women under the Constitution.

Earlier this year, the state Senate voted to advance the ERA. But the bipartisan progress was halted in the House of Delegates, where Republican opponents blocked a full floor vote. The new Democratic legislative majority is poised now to finish the job -- and make Virginia the critical 38th state to back the amendment.

As they celebrated their sweep in Richmond, top Virginia Democrats promised the ERA would be a priority in 2020. "One thing we are going to need to do right away is pass the Equal Rights Amendment in a Virginia," state Senate Democratic leader Dick Saslaw told a cheering crowd.

"It's high time we include the women of this country in the Constitution of the United States."

Virginia may become the 38th state to ratify the amendment, but there are two problems that will cause some legal questions. 1. The deadline for ratification has passed. There is a question of whether Congress can simply extend the deadline, or if they have to start ratification all over again. However, the deadline appears in the preamble of the amendment which is not part of the amendment itself. So the Supreme Court could technically disregard the deadline completely. Constitutional amendments typically have no deadline. For example, the 27th amendment took 203 years to pass. 2. Five states have rescinded their ratification of the ERA. There is a question of whether that is even possible to do. During the ratification process of the 14th amendment, Ohio rescinded their ratification, but they were ignored by Congress.

Theses questions are likely to come down to the Supreme Court.

But either way, the Democrats hope to reignite the debate on the ERA by reaching the 38th state threshold for ratification. That appears to now be certain. The ERA is waking up from its political coma.

Ratification is expired. Also, didn’t one state reconsider its ratification?

The 1970s are calling. They want their political issues back.

The ERA has been deemed irrelevant whether its passed or not. In our new age of gender fluidity, where you can be whatever you want to be, just what is a woman after all? These days its a guy in a dress.

I don’t follow this crap closely, but I suspect that some states will vote to RESCIND their support of the amendment before it becomes law...something else for the Supremes to deal with.

And, once again, our future as a country will be decided in the COURTS, something for people here who think sitting out November elections because so-and-so Senator is a ‘RINO’ is somehow helping the country.

Bottom line, NOTHING GOOD comes from sitting out those elections and enabling Democrats to win - it WILL NOT reform the Republican Party (that only happens in primaries) and it certainly will not help the country overall - in fact, if there is another civil war here, it will be due to DEMOCRAT JUDGES who blow off the Constitution.

(and no, civil wars are not fun, even if you have ARs, tons of ammo, and other hardware - read about what it’s really like before fantasizing, there are plenty of accounts out there)

Virginians voted for higher taxes and higher crime rates. They will get both.

Is there a single “blue” state that has been run as well as Virginia over the last 25 years?

Democrats believe that no issue is ever really decided until it is decided in their favor. They will try over and over and over to get the outcome they desire. At which point it is decided for all time and can never be re-visited.

LOL!

I’ve been thinking about the same thing. I remember the ECO flag and the movement of the early 70’s. The newest iteration is Climate Change.

“Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex.”

Of course “sex” is whatever the Supreme Court wants to interpret it as.

Also, hope women understand the negative sides of this. Gender bathrooms may be going away. Women may become eligible for the military draft. Women may lose some financial benefits if they are a surviving spouse. There could be ramifications involving divorces and child custody disputes. Etc etc.. These are things the feminists don’t tell you about with these issues.

I thought there were only 35 states which had ratified it by the time of the extended deadline.

The 27th amendment is not relevant--there was never a time limit for ratification in that case (and liberals tried to say it was not valid when it was ratified).

Bottom line, NOTHING GOOD comes from sitting out those elections and enabling Democrats to win - it WILL NOT reform the Republican Party

A couple thoughts on that from VIrginia. The Republican voters in my rural district did not sit it out. The polls were crowded the Republican delegate and state senator won easily. But another Republican candidate lost because he was corrupt. Other Repuiblicans and Democrats have been corrupted and Republican rule allowed some Republican corruption to linger. People do not like corruption.

The "swing" counties like Loudoun are no longer swing. They are chock full of brainwashed legal immigrants and libs from other states. Yes, some locals might have sat it out, but not enough to make a difference this time. The partisan hack Democrats were energized in 2018 and this year to a lesser extent. The only thing we have to wait for is the inevitable Democrat corruption and overreach and then they will be thrown out, in some cases by the legal immigrants (e.g. pro-business Koreans).

The Democrats got outside money from the gun grabbers, the globalists and the global warmists. Those groups bought many ads to lie and convince stupid voters. They also correctly pointed out that Republicans voted for private toll lanes with high tolls. None of their ads said the candidates were Democrats. In contrast all the Republican ads announced they were Republican. In a decade or so the Democrats will weaken, but in the mean time they will do lots of damage and probably allow lots of illegals to vote, so it's going to be tough no matter what.

There is a lot of truth in what you say. Democrats NEVER let go of a grudge. If denied something they want they will lie in wait, literally for decades, waiting for the moment to pounce and claim their revenge.

At least now we can watch "woke" Virginia slide into the destruction and degradation caused by democRATic leadership like in so many other democRAT strongholds.

Someone ought to start a pool for when the homeless start invading the place and sh*tting on the sidewalks of their cities.

Sooner rather than later is my prediction.
