A federal judge on Tuesday declined to dismiss the city of Chicago’s lawsuit against former “Empire” actor Jussie Smollett.
U.S. District Judge Virginia Kendall rejected a motion filed by Smollett’s attorneys, The Associated Press reported.
The lawyers argued in the motion, filed last month, that Smollett should not have to pay the city $130,000 because the actor did not know how much time and money would be dedicated to investigating his allegations that he was the victim of a racist and homophobic attack. Smollett told police in January that two men attacked him and used racial and homophobic slurs as they put a noose around his head, prompting an investigation that included almost 1,900 hours of overtime for police officers. Chicago Police Department officials have since said Smollett planned the attack himself and demanded the actor pay for the investigation's costs.
Smollett was initially charged with 16 felony counts, which the country state attorney dropped, leading to outrage and sparking the current lawsuit. A special prosecutor was appointed in August to examine why the charges were dropped.
A spokesman for the city’s law department declined to comment to The Hill, saying the office does not comment on ongoing litigation.
The Hill has also reached out to the Chicago Police Department and one of Smollett’s attorneys for comment.
If I call 911 with a made up story, I go to jail. Smollett gets a pass. Because I’m white and middle class, and he’s black and a TV star. Go figure.

I believe that a decade or so ago a law or rule was passed in Washington state that if you got lost in the woods in the Cascades and they had to come find you, they sent you a bill.
I remember fishing off “dead man’s rock” on the southern Washington state coast and the tide came in so we had to wait to get off. It was a beautiful day so it was no big deal. Except my friend’s wife panicked and called 911 and here came the rescue crews. But by then we didn’t need them.
This was around 30 years ago and I was seriously concerned we were going to get a serious bill. I was very irritated at that woman. Fortunately, we didn’t get one.
Yep...This turkey should have been prosecuted, found guilty and paid a heavy price for his lies and deceit.
