I love the phrase, “open the door.” I was doing a custody trial about 15 years ago and to my chagrin, had not filed the expert documents on one of my experts properly or on time. But the judge let him testify as to facts and observations. All very powerful but then the other attorney who had objected to the opinion testimony in the first place, got up and cross examined my witness on his opinion. I could hardly contain myself because I know that on recross I could get all my witness’s opinions in. The adverse attorney of course objected again and then the judge said those wonderful words, “Mr. L, you opened the barn door and I’m going to let father’s counsel drive through.

Very good. From what I’m reading our side seems to be doing a heck of a good job and the other side, not so much. I feel like they were stupid to pursue this case, but I guess the Devil screws up sometimes.\

Surprised at PP attys though, I would think they’d’ve given them that good old advice: you are a bad person and should stop.
