Judge tells DOJ to charge McCabe or drop investigation

A judge told federal prosecutors on Monday that they needed to charge former acting FBI Director Andrew McCabe or stop investigating whether he lied to authorities.

Judge Reggie B. Walton said at a hearing that if prosecutors don't make a decision by Nov. 15, he would order the Justice Department to release internal FBI documents connected to McCabe's ouster, The Washington Post reported, citing a court transcript.

“I would send this message to those in positions of authority in the U.S. Attorney’s office and the Justice Department ... that I will not condone further delay,” he reportedly said, adding that the case “is just dragging too long.”

“You all have got to cut and make your decision. It’s not a hard decision, and I think it needs to be made. If it’s not made, I’m going to start ordering the release of information because I think our society, our public does have a right to know what’s going on," said Walton, a George W. Bush appointee who once presided over the Foreign Intelligence Surveillance Court.

The government should not be filing charges that they are not ready to prosecute.

It is my understanding that you can be investigated forever. It’s one of the ways that prosecutors and DA’s can harass people over politics. I assume it’s sortof rate but I remember it being discussed in past here, mostly in reference to the context to hounding people in Trump’s orbit.

If a case goes cold, it goes cold. The only time you are protected is if there is a statute of limitations. There is no double-jeapardy for investigations that I know of, but I am no lawyer.

Judge is correct. Speedy trial is a key facet of justice. The bigger DOJ case under investigation is what’s holding it up IMHO.

They want to bundle a bigger case I’m guessing with John Durham. Not sure how that will all go or play out.

Something is out there cooking on simmer.

Maybe DoJ is looking for an angle which they can prosecute in an American federal court instead of the democrat DC district which will have a jury of primarily government workers and democrat affiliates. If McCabe is tried in DC, as a prime never-Trumper, he WILL walk.

If it were something bigger then the judge wouldn’t rush it.

And if it something bigger in a different grand jury then they don’t care about this one and they will charge him in the other one.

I think they DOJ is trying to figure out how to get the grand jury to not charge him.

If so they wouldn’t be in DC right now. They would drop this case and do a grand jury elsewhere.

See my comment above. That is the only thing that really makes sense to me. THey are trying to get the Grand Jury to NOT indict him.

Once again a member of the Judiciary shows they haven’t a clue concerning the separation of powers.

The judges are consistently venturing into the powers of the both the Executive and Legislative Branches.

Personally, I think that McCabe should be charged and I think that the charges should be extreme. He needs to be made an example of. I want him to seriously look at spending the rest of his life in prison without any pension for his family.

At that point if he wish to seek a plea deal and flip on Obama and the others, then so be it. If he doesn't want to flip, then make an example out of his for others to see the price of treason.

Actually there is one of those Constitution thingys that mandates a speedy trial. The government should not be filing charges that they are not ready to prosecute.

There are no charges filed.

Adding to my earlier reply to your post, I thought criminal issues always ‘trump’ civil issues in court, so I am not sure this judge has any say in forcing DOJ’s hand on a criminal investigation.

There are no charges filed.

EXACTLY. The speedy trial does not take effect till the charges are filed. The judge must be acting on a motion by McCabe’s attorney. They know something is out there and they are trying to defuse it by forcing the prosecutor to rush a charge and bring forth their case now IMO. Judge should have no standing in when charges are brought, unless there has been an indictment or information filed.

He waited until after the 2018 midterms even though he knew Trump was innocent.

This is election manipulation on steroids.

Its a big reason why they can’t stop pushing this BS. If the public realizes how much they have been lied to then not only is the Rat party done but so is the Media.
