You are correct. Almost all states will not allow deer hunting with a 5.56mm cartridge.

Some states even disallow 7.62 for deer, big game hunting.

What states don't allow a .30 caliber for deer hunting? A .300 magnum is a 7.62mm. That is enough gun for anything in North America (with the possible exception of a Kodiak brown or polar bear where I'd prefer a .35 or larger bullet).
