MILLER: Well, we’re looking at all legal options. But I think the key point I want to leave you with today … is that many legal scholars believe that the phrase “subject to the jurisdiction thereof” makes clear it does not apply to people here on a temporary basis or here illegally. And so the point would be then, what can we as a government do to execute the president’s obligation to “take care that the laws be faithfully executed.” The Constitution, being the supreme law of the land, and so what is the correct interpretation of the 14th Amendment. That’s something we have to look at.

ROBERTS: So when do you plan to do this?

MILLER: I don’t have any news to make on that today, but I want to leave you with this: For years, Americans had politicians of both parties come and go and surrender their interests to foreign countries and foreign powers. This president, alone, has stood up and protected

calling the policy “frankly ridiculous.”

What’s even more ridiculous is the belief that the children of foreign nationals can NATURALLY be citizens of the US when they are also born with foreign nationalities.

Natural born citizens are NATURALLY citizens because they cannot possibly be anything else and have only ONE nationality.

Once Trump gets Amy Coney Barrett on the bench he can issue his executive order and let it go to SCOTUS for a decision.

"...is that many legal scholars believe that the phrase “subject to the jurisdiction thereof” makes clear it does not apply to people here on a temporary basis or here illegally."

Uh, no. "Many legal scholars" do not agree with this. Just a few, who want it to work that way and so ignore the text. And that's not what "subject to the jurisdiction thereof" means.

People here temporarily or illegally are still subject to the jurisdiction of our laws. They are not immune. Only those people who have legal immunity, that are not subject to our law, are not "subject to the jurisdiction". This is not some arcane legal point. There are few words in the law more well defined than "jurisdiction".
