What we need is a 3 Strikes Law for Judicial Decisions that are overturned.

The judge ruled that in the initial news coverage of the incident, The Post never mentioned Sandmann by name and instead only referred to groups of "hat wearing teens" and other classifications that did not point to Sandmann's involvement specifically, saying "the words used contain no reflection upon any particular individual" and thus could not constitute as defamation. In addition, the court ruled that the newspaper used language that was "loose, figurative," and "rhetorical hyperbole" which the judge determined is protected by the First Amendment. See, that is the system we have to delegitimate. The system is that individual members of the journalism cartel diffuse the responsibility - but the reality of the cartel is that overall, clear libel has occurred. My position is that it is futile to go after one newspaper here or another newspaper there. You have to sue the whole lot of them. Your defendant must be the Associated Press and it membership, joint and several liability. And, if that bothers you, throw in all the other wire services as well - same difference, they all have the effect of homogenizing journalism into a leftist cartel.

Oh wow, the Post defense was terrible, basically just said “we don’t think a jury would consider what we did bad”, didn’t actually offer legal reasoning why the case shouldn’t be brought to trial, just Post doesn’t want it to. And they got a judge who figured sure, why not. Bad day for the rule of law.

There is certainly a good argument that if the article didn’t mention the plaintiff’s name there is no defamation. I wonder if they published his picture, though. That would make a big difference. Unless they published his picture this does not get overturned on appeal even in Kentucky.
