Dismissed with Prejudice does mean can’t be filed as is again. Appeal available though. And filed under different legal theory may be possible.
Any attorney doing that would likely get sanctioned. An appeal may be possible, but it can’t be refiled.

There is certainly a good argument that if the article didn’t mention the plaintiff’s name there is no defamation. I wonder if they published his picture, though. That would make a big difference. Unless they published his picture this does not get overturned on appeal even in Kentucky.
