AllahPundit doing his usual. No, Barr did not mischaracterize this at all. Mueller tried to play games and Barr stomped him. If the underlying reason for the investigation was bogus, then you had better present one heck of a strong obstruction case. You had better say, “we could not investigate because of the target’s conduct.”
Instead, Mueller did several shady things. First, a prosecutor either indicts or declines. He doesn’t issue a report that slanders the target. It’s not Mueller’s job to exonerate. Second, you don’t base your obstruction theory as a stand alone from the underlying case from the get go. What the heck is “obstruction of a potential future investigation?” Third, you don’t pitch your slander memo over the wall and say, “you decide whether it is obstruction or not.”
The clear lack of exculpatory evidence is ITSELF (prima facia) exculpatory evidence.
