WASHINGTON The Internal Revenue Service has no choice but to honor congressional requests for President Trumps tax returns unless he invokes executive privilege to protect them, according to a draft legal memo written by agency staff members.
The memo appears to undercut the reasoning offered by Treasury Secretary Steven Mnuchin, who has refused to comply with Democrats requests because they lack a legitimate legislative purpose. Mr. Mnuchin said he made his decision after consulting with lawyers from the Treasury Department, the I.R.S. and the Justice Department.
But the I.R.S. memo says the Treasury secretary does not have the authority to deny tax-writing committees requests for taxpayer returns.

Somebody in the IRS thought there was a federal law forcing the IRS to submit the tax returns of anybody when congress demands it (including me and you). If so, that law needs to be amended in my opinion.
I wonder if we want the courts telling congress it can't enforce a law (again).

Tax returns should be protected period - unless a judge issues a warrant in connection with a criminal case.

A "draft" is an internal opinion memo, not an established intepretation. It would be interesting to know when this draft was written, how seriously it was taken at the time, and by whom it was written (as in long-term Obama sympathizer or appointee), and what the position of the writer was (e.g., a junior staffer).
If the draft never made it to the level of agency policy, and was never acted on, the policy is whatever the current high-level people say it is.

Would his personal medical records, held by his personal physicians, be covered by executive privilege if Congressional RATS subpoenaed them? What about personal emails or texts produced in the past and held by non-governmental service providers? What about the records of credit card companies whose cards Trump has used in the past? What about his account records held by his various banks? What about his passport records? I could go on and on. What are the limits of Congressional RAT powers?
