The problem is that the way they test for pot use is stupid, maybe they should test for ALL Mood altering substances the same way. If you have Used Alcohol or ANY Prescription drug in the Past 2 months you FAIL, then they should drastically Expand their Testing to ALL Management and maybe even Stockholders, just to be fair. Maybe showing up with a Hangover should warrant Immediate Termination also.

Personally I don’t care if you smoke a little weed or drink a little AFTER WORK, Show up clean and Sober and do your job and don’t let you extra curricular activity affect your work habits.

The problem is if this employee causes an accident or death while on the job, who are they going to sue?

I would not own a business today.

Alcohol disappears from the system fairly quickly after use, at the rate of one drink per hour. So no one is going to test positive in the morning if they had a couple of drinks the night before. Marijuana components, on the other hand, are fat soluble, so it stays around for days or weeks after use. And we still have very little data on how long impairment lasts after marijuana use. The fact that the high has ended does not mean that the person is no longer impaired. Unlike alcohol, which is a simple very small molecule, marijuana contains several cannabinoids, all of which react with numerous cannabinoid receptors in the body to create many complex effects in addition to the high. You cannot compare the complex multiple effects of marijuana use to the effect of simple alcohol use.

What all of this boils down to is that the testing methods are absolutely appropriate.
