Can he sue the commission or its individual members to recoup some of what he lost?

I agree with this...make the Commission repay all the legal fees plus punitive damages.

Further, all members of the committee are fired and any benefits are forfeited.

You can sue for just about any thing. But whether it will be
a winner is the question assuming it doesn’t get thrown out.

I believe he did sue, and dropped his case in exchange for the Commission dropping their case.

The commission will claim some type of statutory immunity similar to prosecutorial immunity.

I do think they can and should be sued for millions and sued as individuals not protected by the state. This is no different than prosecutorial abuse a la Nifong (Duke Lacrosse case).

Suing the commission makes the taxpayers of Colorado pay but suing individual members on Federal 1st amendment grounds or malfeasance will $end a clear me$$age.
