National Guard weighs punishment for Rep. Adam Kinzinger over criticism of Wisconsin Gov. Tony Evers

MADISON, Wis. — Wisconsin National Guard officials said Tuesday they’re looking into whether to punish an Illinois congressman who belongs to the Wisconsin detachment for criticizing Gov. Tony Evers‘ decision to withdraw troops from the U.S. southern border.

Republican Rep. Adam Kinzinger is a Wisconsin Air National Guard pilot with the rank of lieutenant colonel. He ripped Evers Monday on Twitter and on Fox News for ordering Wisconsin troops to pull out of Arizona.

Wisconsin statutes state that any commissioned officer who uses “contemptuous words against the president, the vice-president, members of congress, the secretary of defense, the secretary of a military department, the secretary of homeland security, or the governor or legislature of the state of Wisconsin shall be punished as a court-martial may direct.”

Evers is a Democrat. His position as governor automatically makes him the commander-in-chief of the Wisconsin National Guard. Asked if Kinzinger might be disciplined for his remarks, Guard spokesman Capt. Joe Travato said the Guard and Evers‘ office are looking into the matter.

Kinzinger’s spokeswoman, Maura Gillespie, said in an email that Wisconsin law makes clear that such restrictions only apply to members while “on service.” She did not respond to follow-up questions from The Associated Press seeking an explanation.

It would seem highly unlikely that a pilot would ever make a unseemly remark towards a politician while flying their plane. Much less over an open mike.

I half-way hope that they do decide to attempt to court martial the Congressman. Would be a great campaign ad for 2020...for each and every single Republican in the country.

How about the DEATH THREATS that Governor Walker got from Wisconsin Socialists/Teamsters/Teachers/Union Thugs on a DAILY basis? Threats against his Wife, Sons, Parents and his dog!

Not at all - The congressman is obviously speaking on behalf of his congressional/political duties (which are professional in this case) and not on behalf of the guard.

Now I think this makes an interesting case though - should elected officials still be active military?

The principle of parliamentary immunity — specifically as it applies under the U.S. Constitution in the “Speech or Debate Clause” — would almost certainly protect Kinzinger from any legal action by the State of Wisconsin.

Since he called radical democrat Evers out, and is a Republican, and because Evers is his CIC, he’ll be found guilty and shot at sunrise. One less Republican in the House, therefore with that vacancy, Evers will appoint a loyal radical Democrat crony to replace him, preferably from the SEIU or the Wisconsin Teachers Union. Repeal of Act 10 and everything Walker did is just a judge away.
