One common theme on the “Second City Cop” blog is what a worthless sack of excrement Kim Foxx (the Cook County DA) is when it comes to prosecutions, especially involving certain demographics. So you’re almost certainly correct - if it’s up to Foxx, he’ll skate, at least at some level. Now if the feds get involved, that could be a different story.

The Rolling Stone story was basically a fictional story mislabeled as nonfiction, which isn’t actually a crime. No police report was filed, so couldn’t be any false reporting charges. No actual person was named as the perp (though people later speculated that a real person was used as the basis for one of the characters), so there could be no libel or slander case either.
Now with this case, we have false police reports, we have terrorist threats sent through the US mail (not just to himself but to his workplace), and we have payment of money to people in order to perpetuate a hoax, which is probably grounds for some type of fraud and criminal conspiracy charges as well.

So, Jussie paid some guys he knew from his acting gig to give him a beatdown in order to get national publicity for a fake hate crime. Only, the beatdown was pointless because it was not captured by a security camera. And then his fraud gets uncovered. So, instead of boosting his career and becoming a hero, he’s exposed as a fraud, destroyed his career, and may end up a convicted felon serving time in prison.
Actually, there WAS libel, and Rolling Stone settled for big money.

On November 9, 2015, Phi Kappa Psi filed a $25 million lawsuit against Rolling Stone in state court “to seek redress for the wanton destruction caused to Phi Kappa Psi by Rolling Stone’s intentional, reckless, and unethical behavior”.[164][165] In September 2016, the magazine sought to have the lawsuit dismissed; however, a circuit court judge ruled that the suit could proceed.[166] On June 13, 2017, the lawsuit was settled for $1.65 million.[167]

Using the US mail to fabricate a terrorist hoax. Thats a major diff. Its federal and cant be buried by the locals or the state. It snowballs. As I said on another thread, if Roger Stone gets the Bin Laden treatment for a process crime and this guy gets off for filing a false police report AND using the mail for a terroristic hoax...two felonies (plus whatever else there is)...then I give up. Trumps DOJ may not can ensure that he pays for the false police report but they CAN ensure he pays for the fake mail threat. If nothing happens...stick a fork in this country, there is no justice possible and the truly guilty will never pay.
